I can see where the guy would find the dealer's lack of response even more annoying.

$400 thousand dollars spent on their products and they won't even give the guy a new seat?

I'd be livid!

The dealer would get to know me very well if that were my vehicle and I carried passengers in that seat.

The dealer doesn't have the airbags....it's not their fault, they are waiting just like everybody else...Neither does Ford or Honda or any of the other vehicles recalled for the Tata airbags...When they get the replacements they install them but they can't change them all at once...You have to know who to pick your fights with and when....

It's not just about the seat.

The torn seat and their being oblivious to the guy's problems is a metaphor for their having lost their way is what the guy is saying.

We've seen this 'go fcuk yourself' attitude from Silicon Valley countless times before where they get themselves into such a position with the customers that they feel they can insulate themselves from any comeback by fiddling with the small print and ever changing customer agreements, which itself fosters this attitude and removes the parent from any direct contact with the customers by handing it off to the dealers, to the point that the only way to respond to that is by doing what this guy is doing in taking legal action in the forlorn hope they might wake the hell up from their complacent stupor.

But as usual with Silicon Valley, this guy's and every other complainants woes are falling on deaf ears or his legal action would never have gotten this far.

Well first of all you're only getting his side of the story....he could have an axe to grind for whatever reason....I've seen people come out and badmouth a company because they were short the stock, in fact this happens all the time....Anybody that would take this guy's story at face value is a fool....he could be lying through his teeth you wouldn't know the difference....Where's the flood of other customer's complaints? This sounds like anecdotal evidence to me at best...You want to know what's going on with a company, look at its stock price, you can't fool the market....

I had our Takata air bags replaced on our Honda.

When we received the notice that they needed replacing, we went in and said we weren't comfortable driving the car and Honda got us a rental car (that they paid for)until the bags were installed . We had the rental about a month. We were told about this by the wife's coworker who didn't even wait for the notice. They took in the newspaper article and had a paid for rental for several months.

I also assume if they are paying for your rental, you will go to the front of the line when the bags come in.

One characteristic of many (techno-pioneers) is that their competitors tend to, first, learn from the originator's mistakes, and then, a few of those competitors go on to surpass those originators ...

(e.g.: Wilbur and Orville Wright repeatedly demonstrated that powered human flight could actually work, but they never got much of a Contract to build (aircraft) for the U. S. Military... Essentially, they just wound up showing their budding competitors one way how to do it, who in turn, figured out their own improved ways of doing what ever their particular ''it'' happened to be...)

So, we'll just have to watch and learn what the rest of the Testla-story turns out to be... (film at eleven?...)

This too may, some day, also become serialized and/or soap-opera-ed on Netflix...

Tesla is over-extended. Look at the price of a share and the dividend (what's that?). They can't afford the money to provide proper after-sales service. Are you thinking of getting rid of your Tesla? Watch what happens when the stock market tumbles and the lenders call in their monies. You'll really be worrying about your service then. Meanwhile enjoy!

Cohen's "litany of problems" bullet list has a familiar ring to it - a lot in common with those of the personal computer as it matured. And they still persist. The problems would kill your productivity and piss you off, but they didn't get you stranded or injured or killed. Take his list and increase it a few orders of magnitude. That's the fun future of self driving cars that awaits us as we involuntarily beta test them for their manufacturers.

Oh, and yes, SE, you can fool the market in my opinion. Maybe not forever, but for a while. I think we're in the middle of that while.

You forgot Fraud, they had fraud in common...I don't see the relevance unless you're accusing Tesla of fraud??? Since I haven't heard that mentioned, I'll assume not....therefore your argument is without merit....

I don't think you get it.

The fraud in all those cases I cited wasn't discovered until after each of the enterprises went down the tubes.

The article I started this thread with was about signals and the author was saying the signals that are starting to show indicate that Tesla is losing its way.

Which is always a precursor to companies going down the tubes.

But if you want to go on the fraud angle, Tesla has certainly committed a fraud by first admitting they ruined his seat and then not honoring their pledge that they would replace his seat.

Along with a host of other issues, which all remain unresolved.

That's why the guy is suing them - for breach of contract, ie, fraud.

They promised things they didn't follow through on - and that's fraud.

So if he has so much proof as he says he does, he should have no problem prevailing in a court of law....You are assuming facts not in evidence....He may turn out to be completely delusional...Accusing someone of fraud, is not the same as proving it...besides one angry customer does not rise to the level of an Enron fiasco by any definition...
