Highway Construction on the Cheap

I discovered from a state inspector that the State Certified Concrete Plant Operator had been taking home the testing molds he was to present to the state for approval and mixing up his own batch and then switching them back at work for presentation. Funny part is at the end of the job and with the last truck full leaving the plant he opened the truck of his car and withdrew a sample in front of the State Inspectors. They quickly stopped that last truck and called for the owners of the company. The Certified Concrete Plant operator was fired on the spot.

One problem is with his firing! This State Certified Concrete Plant Operator took with him all the liability for the millions of yards of concrete poured in the construction of the Highway and bridges.

This set off an extensive check of all bridges and overpasses where the State is rebuilding and refitting at great expense to the citizens a highway project that was already over budget. I can only imagine what beach that State Certified Concrete Plant Operator has settled on. He saved his employers a few million in materials but also removed all their liability for the project since his State Certification was the one demand the State made where they took all the liability if he failed.

Actually he hasn't saved the company anything yet. If the State is re-doing inspections of all materials, used in what sounds like a large rebuild and refurbish project, then they should and probably would hold the concrete company and the plant operator liable for any or all costs related to the retesting, inspecting, replacing of any failing materials. Not to mention that the State will most likely either ban or place the concrete company on some sort of limited particapation on furture projects with the State.

They may also go after the concrete company and the plant operator in civil and/or crimminal court depending on contract and specifications for materials testing. This would entail covering orginal cost of construction, time and materials testing, court costs, and probably some sort of liguidated damages for delays in completion of original contract completion date.

In the end, he (the plant operator) has probably actually cost the concrete company millions of dollars in lost revenue.
