EPA Revising UST Regulations

The notice in the federal register identifies Manufacturing Sector NAICS codes 31-33 (that's us!) as potentially affected by the proposed changes.

EPA's proposal revises the UST technical regulation in 40 CFR part 280 by:

  • Adding secondary containment requirements for new and replaced tanks and piping
  • Adding operator training requirements for UST system owners and operators
  • Adding periodic operation and maintenance requirements for UST systems
  • Removing certain deferrals
  • Adding new release prevention and detection technologies
  • Updating codes of practice

While we don't see this update as unreasonable (its been 24 years since the 1988 UST regs first came into effect) we could see how the updates could result in large expenses by small manufacturers if they are required to update secondary containment and interstitial montitoring for their USTs.

It's about time the rest of the EPA and the rest of the country catches up. Most of these requirements have been in affect in states like PA since 2000.

As far as expenses I'd rather pay for up-grades which is minor when compaired to the expense of going through Phase I, II, and III clean-ups.

PA has had a training program for the past three years. It's a great idea it gives operators of UST a better under standing of their equipment, tank management, etc.

What's wrong with that?

Nothing wrong with that . My why this rule question was actually a caption to a photo showing leaky tanks that photo did not get uploaded to cr4 post.Please see my original post at the link at the bottom of my cr4 post. Milo

I answered Miles question and was just replying in general what's wrong with the rule and the UST training requirements.
