PMPA Testifies on OSHA’s Proposed Injury and Illness Reporting Rule

PMPA recently provided formal written testimony, additional supporting comments and an estimate of implementation costs at the recently held informal hearing at OSHA in Washington D.C. last week.

You are busy enough running your shop and serving customers, so we prepared comments and went to Washington to represent the small manufacturing companies like yours about what we thought the proposed rules' impact would be.

We had three broad themes:

  1. No safety or health outcome benefit for workers has been established;
  2. On line reporting will discourage recruitment of employees to manufacturing careers;
  3. Encourages employees not just employers to mask injuries and illnesses. An unexpected outcome due to changes to worker deductibles in their health insurance due to the Affordable Care Act may result in a spike of false 'at work' injuries being reported . from employees with non work related injuries who may balk at personally paying their new high deductibles for emergency care.

We provided formal comments prior to the meeting.

At the very least, this sounds like an incredible waste of time.

I hadn't considered the possible fraudulent reporting of workplace injuries, as a response to the ACA, but I can see it happening.

Matter of fact, I just saw one of the misleading ACA ads on TV, which features young people bragging that they are covered...whether it's a broken leg, or just a checkup. What they fail to mention, is that they are covered after they pay their $4000- $5000 deductible.

It certainly doesn't appear that the government is interested in stimulating hiring...or even business creation.

I'm working on starting an online retail site, and it's looking like I may have to somehow collect sales tax for every state, and be responsible for getting the money to them. I don't even know where to start on that. It's sounds very complicated and time consuming though.

If the "sales tax" goes through, software is supposed to be developed that calculates the tax. This will prove at least as hard as the ACA software, as not only are there state taxes, but counties and municipalities also have there own taxes. Then what about the "off shore" suppliers who have no skin in the game? I can see the other side as "brick and mortar" stores not only have the overhead of the facility, but then sales tax as well.

As an aside, I needed a TV antenna. I found what I needed, a $50 UHF unit. I went to both national stores that sell antennas and related products. Neither carried this antenna, even though it was listed in their on-line catalogs. Both stores carried a $120 "equivalent". Neither store would order this antenna. I then tried to order it on line. I discovered neither store would ship to P.R. I then re-ordered and shipped it to 'bro, in TX. The transaction failed again as neither on-line store would ship a product if the CC billing address was P.R. ('bro sent me the antenna as a Christmas gift.)

I just heard on TV this morning, that Amazon is going to start charging sales tax in NC.

The thing that worries me about the online sales tax thing, is that even if I have software to decipher it, somehow I have to spend my time physically getting relatively small amounts of money off to the respective states, and tracking each purchase from 50 different states, separately.

It sounds like a nightmare. I don't have a lot of time and resources to commit to keeping revenue collectors happy, and still be able to make some money for myself.
