Looking for Advice

06/22/2018 9:51 AM

Good day all,

I own a freight company and I transported 2 boats from MD to OH. It ran me around 3k. Now
the broker is not answering my phone calls or emails. What can I do about this?
First time this happens to me. Thanks in advance.

Uh boy, okay.

Take a minute, collect all of your thoughts about this issue, then type out a story regarding the issue.

This will much better than multiple exchanges like “What money” and “What broker”.

A good story tells us Who, What, When, Where, and Why. Please begin with those.

Posting #3 sounds like a winner. It might have a limitation if the destination is a fake company or a company/person that has declared bankruptcy. Collecting against something that doesn't exist could be a problem.

Check to see if a "mechanics lean" can be filed against the boats. I don't know if it is possible. I don't know if it is a good idea. Just a suggestion.

Depends on the contract....did you have payment insurance? If you did business by word-of-mouth agreement, then you have little recourse...Are you sure you didn't unintentionally steal the boats?...or that the boats weren't stolen by the drivers?....What delivery confirmation do you have?....You might hire a private detective to track them down, then go from there....

Wow, that's sad to hear. I guess this is why so many truckers want us to pay them directly, not the broker.

I would start with a demand letter. If it doesn't work, you'll need to take them to court. Most likely small claims. I would also try to get the DA's office to help. If all that doesn't work - you win the case and can't collect - you could always "visit" the broker. And don't forget to bring friends!

One final thing you can and should do. Go to the transport site and post a negative comment. I'd also do it on Linked In as well. Google and Yelp aren't bad ideas either.
