NDA or Confidentiality Agreement with Korean Agencies

10/06/2010 12:10 PM

Does anyone have any information concerning how to obtain a Non-Disclosure Agreement / Confidentiality Agreement with any Korean Agencies?

if so, please provide some guidance on how to obtain. I have been researching and working with other agencies and have not had any luck.

thank you

Within which venue would violation of an agreement be enforceable?

I'm assuming you're referring to South Korea.

A good place to start would be the Paris Convention. South Korea is a member.

Very easy. Go to CIA and ask copy.

Any such agreement is only as valid as your ability to enforce it should it be breached.

Perhaps a stateside corporation could be formed where verbiage could be included to the effect that local assets could be transferred to you should such a breach occur - it could serve as a form of collateral while encouraging a good faith arrangement for future growth if no breach were to occur. Placing a value on your intellectual property is not an easy thing - but you may want to seek expert legal advice from an IP lawyer before giving it away on an unenforceable NDA.

Best way to handling NDA is

1. Have your NDA blank If you do not let me know I will send you an standard one which will be one way and it protect you

2. Fill it out sign and send to organization

3. They will modify and then sign it off and send you your modified copy of your NDA for your signature

4. Take that NDA to lawyer and if lawyer approves it or you are satisfy with the risk and reward of the business sign off. If not then modify and send again after few to and fro things will happen

This my experience with ministry of industries of Korean Government
