Letter For Claim

Dear All

Our construction work still have 1 1/2 month before the MC date and during the construction work we have unforeseen additional work, however in the contract view the cost manager from client have issue a letter to expedite the submission and closure of the variation order within 10 days. I've issue a reply letter to client to consider our claim but no response, therefore if the date line over then our claim will be forfeited. Any advise please.

great example of why regular face-face as well as phone contact are vital aspects of any contract completion. things happen in life, you should be talking to them, not this forum

I suspect the people that Moh'd is dealing with would rather not visit with him.

I suspect (from information provided so far) our friend is about to get hosed out of his money, the other involved party looking toward the stated expiration.

Stall, drag their feet, ask for ridiculous documentation, stall some more... seen it once or twice myself.

Not that I'm bitter about getting hosed out of money by such a tactic

This is a good example of poor management, poor project definition, poor negotiation, poor definition of responsibilities, poor definition of deliverables, poor definition of authority, poor understanding of the scope of the project, poor workmanship, just about a textbook example of a complete lack of leadership.

I'd leave now, before the project fails miserably and the blame is properly, or otherwise, allocated to those in charge.

Whats the contract say about additional work? Send all requests for compensation for the extra work register mail so you have a signed and dated receipt. Tack on the extra cost for the registered mail to the bill. Have any new additional work approved in writing from the cost manager.

They are hoping that you will do the work with no response, and that negotiations can happen after the fact.

If it were me, I would not do the work, and I would resubmit the change order every day, with a reminder that the closer to the end of the project you get, the less likely it is that you will be able to complete the work on schedule, and that any additional personnel/overtime that is required, will be billed on top of the original change order, with a price per manhour included.

I used to enjoy things like this, and made the company I worked for, a lot of money in the process.
