eBay Seller Sues Autodesk for $10M

A lawsuit has been filed in Federal Court (US District Court for the Western Washington District C07-1189 JLR) that alleges Autodesk, Inc maker of the industry standard AutoCAD software and their attorney Andrew S. Mackay have devised an illegal scheme to have used copies of their software removed from the eBay site using the Digital Millennium Copyright Act. The law passed in 1998 was designed to give intellectual property rights owners a way to have content removed from the internet that violates copyright law. An example would be a television show uploaded to YouTube without permission from the production company. The right to sell an item that has been legally purchased is protected under copyright law. The first sale doctrine allows an individual to transfer ( i.e. sell, giveaway etc.) a lawfully made copy of an item without permission once it has been obtained. The doctrine has been part of US law since the Supreme Court recognized it in 1908 and covers everything from books and DVDs to clothing and automobiles.

I'm right behind him. Autocad are sharks for trying to pass off that shrink wrap con as an agreement. It's nothing less than fraud.

I think a good question would be what if it was a movie or song, instead of software. Mindful that for some reason people are more understanding of paying for a luxury than a perceived necessity. If you were selling a copy, or even giving away a copy of a Metallica song, instead of AutoCad would that not be the same thing (except metallica has not special use in business or life, just a luxury).

"The right to sell an item that has been legally purchased is protected under copyright law." That means if you legally buy a product you can legally sell it too. We are not talking about pirated stuff, this guy bought and paid for it, same as you would if it was a song or a film. Otherwise, if Ford, GM, Boeing et al were to go along with the Autocad crap line of thinking they would have us all buying new stuff without being able to trade in our old stuff.

I quit using AutoCAD 10 years ago. Why is anyone still using it. Obviously, this guy wanted to get rid of his.
