Many jurisdictions contain provisions to limit the amount of noise and smoke that things can emit, with penalties for breaching them. Such things are embraced by subsidiary legislation and are not contained within any <...constitution...>.

What I would be annoyed about is Harley Davison owners bikes. It appears they’re trying to prove something they are not.

the sound is blasted behind them, I can hear them 100 yards on a highway. But worse is when they are riding in a residential area.

I can't count the number of times I have thought that a noise signaled that something had gone wrong with my engine, only to discover it was just a Harley passing from behind.

The real irritant,and danger, is the boom boxes playing at gigawatt level.They can be heard miles away.

A friend had a pacemaker to repeatedly misfire because the vibration of the noise triggered it.He was in parking lot when the vehicle drove by,and the vehicle circled the lot several times,each time triggering an event with the pacemaker.

It is not a pleasant experience when a pacemaker fires.

Sometimes they leave a vehicle with the boom box playing,max volume, at the gas pump while they go inside to pay or shop.

Anyway it's not about that, it's about the law holding the aftermarket custom shops responsible and threatening the businesses and aftermarket shops that provide these services that sell and install these parts....This sets up an arbitrary attack scenario where certain shops can be targeted and others not... and you know who's going to get targeted, the little guys...any of these loud mufflers can be dealt with under existing laws, the problem is lack of enforcement, mainly because these violations are few and far between...and really who cares? It's like holding the gun manufacturers responsible for how their guns are used...they have no control over the situation, so how can they be held responsible?

Now, as an aside: I was riding my Japanese cruiser motorcycle at a local meet, and a man stepped off the curb right in front of me. I hit the horn, and he turned and screamed at me " Get a louder exhaust, I didn't even hear you!". What do ya do? Is the new ruling a primary or secondary violation? At least in Maryland, the police can only hit you up for certain violations if they pull you over for something else. If you are driving your custom car, and spin the wheels, then they can nail you for an exhaust issue.

As far as what you mentioned, sure that could happen, they were having the same thing with the cars, being so quiet that manufacturers thought about how to avoid it...

But one thing about that man stepping off the curb,... once his foot is off the curb, on the crosswalk he has the right-a-way. In my younger days,... I dated a nurse who was a firm believer of this, and she would step of the curb on the belief that she had a right-a-way. I grabbed her a number of times, then finally I said to her... that I'm going to put it on your tombstone as your epitaph "I may be lying here, But I did have the right-a-way"

She soon looked both ways and waited to make sure the car stopped.

And my story... I was driving along down the highway with my car window open..., and a Honda Gold Wing passed me in the next lane... I was impressed, the damn thing sounded like a sewing machine.

I also dont like my motorcycles so loud I cant hear my bluetooth radio or phone, so no custom exhaust for this guy. Wasnt there some agency looking into what type of sound EVs should make? My elderly shepherd almost got hit by our postmans Prius when they pulled into the drive. Poor boy just didnt hear the thing...

This law is constitutional for the NYS government has jurisdiction over what vehicles can operate on public roadways. This new law that went into effect April 1 (this is not a joke) does not change what can or cannot be done to an exhaust system. The law changes what penalties can be levied on violators, particularly flagrant violators.

There are noise laws and disturbing the peace laws that already exist, this is another useless law on the books that will not be enforced fairly or equally.....pretty soon there will be so many laws that everybody is constantly in violation of some law and therefore everybody is subject to arrest at any time giving rise to political enforcement and punishment for anybody who's opinion doesn't agree with the prevailing groupthink....does that sound familiar?

As usual you completely miss the point, and draw an erroneous conclusion...The automobile aftermarket is approaching a Trillion dollars in the US alone and employs millions of people, and many engineers, an attack on this industry is an attack on jobs and small businesses everywhere....

The SLEEP Act (now you know the name of the act) does not make loud exhaust modifications of public road use vehicles illegal. It is already illegal to do this and it has been for decades. The possible penalties have changed. This does not affect vehicles used solely on private property, like race tracks. The owners of that private property set the rules for using their property. The engineering of aftermarket parts intended for track usage will not change. The market for these engineered products might shrink because fewer people will be willing to break the existing law now but the engineering will stay the same.

That’s just a region… this is better by going through the states… I don’t know if it’s totally enforced… I doubt it.

Secondly,… As far as not all laws are enforced, that’s typical. But the argument should be, just because there are laws not being enforced, doesn’t give the excuse to created more of the same laws that there are already laws on the books for, that can really muddle up the law books. Because how bureaucracy works, the laws will have a little twist, they there is not a right way or way way and then lose it original meaning.
