The phos is .035 wt % max, so .078 would be out of specification.

So the material does not meet the chemical requirements of EN19.

The effect of the chemistry being out of spec is that if you use it, you will be liable for not using the specified material. and so likely held liable for any and all damages that could ever happen, which will be attributed to your failure to follow the specification. Regardless of whether that level of Phos was the actual in fact cause.

From a practical sense, that level of phos is unlikely to do anything at all to the steel, except perhaps contribute a little bit nicer surface finish during machining. You might persuade me that it lowers the ductility a shade, but I'd have a hard time proving that to the satisfaction of a jury, let alone a reasonable man. But PHOS in combinationwith nitrogen can elevate Yield strength and decrease ductility.

But the fact that the material is out of spec casts doubts about all other workmanship and production quality attributes explicit or implicit in the order.
