Look into HIPAA Privacy laws. They may apply.

Hello wgh71

I would refuse, and because you are in the US, say that "under the Constitution, your prescription medications, if you use any at all, are not the business of your employer".

In most jurisdictions, if you voluntarily give information, and sign to say it was "given voluntarily", (because there is always that little catch-all clause),you may discover in the "fine print', a short clause which says "I acknowledge further enquiries may be made" or "this information may be shared, to ensure a safer workplace", or similarly worded "giveaway" clause.

That is a warning to you, to be very careful with whom you share personal information or data.

Once the information has been released, there is, unfortunately, no way of ever stopping it from being on-shared with others, including Insurance Companies, Mortgage Holders, Banks, Political Parties, Church Groups, Tax Authorities, Police, FBI, CIA, and so on.....

If you are ever forced to sign a document, whatever the nature of that document, sign with a signature other than your normal one, adding the written words "Signed Under Duress", and insist you get a copy of that document immediately, so you can give it to a trusted friend.

Hope that helps you decide your course of action.

Kind Regards....

I don't want to start a "war" but... Specifically WHERE in the US Constitution does it say that your employer can or can't do anything???

I would think that maybe under some state or federal STATUTE, you may be protected from being asked that information. If I were you, I would consult an attorney that SPECIALIZES in Labor Law.

Look, I know it sounds like I am Nit Picking, but I just HATE IT when people put things into the Constitution that JUST AREN'T THERE...

Don't get me wrong, I DO AGREE with you that you should NOT volunteer ANY information that you would not want on the front page of a newspaper... I am a big advocate of personal privacy, ESPECIALLY with any GOVERNMENT Agency. Remember, Love your country, but FEAR your government...

Hello ARMY-MARS-GUY

The Original US Constitution was based on Common Law = God's Law, being Common to God and Man.

All Statutes whether Federal or otherwise, in every Country on this Planet, are based on the Law of the Sea = Mercantile Law = Admiralty Law.

It is a long and convoluted story, but how Statute Law has endeavoured to take away the God-given rights of Freemen everywhere, can be researched, should you wish to do so.

All Statute Laws, including "The United Nations Declaration of Human Rights", and the like, are carefully crafted to remove, (or endeavour to remove) Common Law Rights, by trickery and the willing ignorance of Living Souls, who do not realise that once they were free, and now have become voluntary slaves, because they relied on Statute/s, Government, Politicians, a genuine Peace Officer system (Police Force), Lawyers, Courts, and similar persuaders.

Kind Regards....

The sad fact is that we are habitually or routinely asked for personal information just about every day these days and it's very often 'for our protection'.

HA!

Don't give it. (On the other hand give opinions freely, it's much more satisfying - except for those nearby)

As far as I know, your employer has no right to any medical information that does not relate to your ability to do your job. They can get info on a workman's compensation related claim but I think that's it.

Is it possible that they want to know if any employees are taking a "mind altering" medication that might affect their motor skills and or capacity of judgment, etc?

In fairness to the boss, it's possible that the companies insurance provider is pushing for info so they can lean on him for a greater premium.

Thank you for your input. I have decided not to share and notified them of my decision. That was a week ago and nothing has been mentioned since. I appreciate your views.

Hello again wgh71

Edmund Burke would have been proud of your stand.

  • The people never give up their liberties but under some delusion.
    • Speech at a County Meeting of Buckinghamshire (1784)

  • People crushed by law, have no hopes but from power. If laws are their enemies, they will be enemies to laws; and those who have much to hope and nothing to lose, will always be dangerous.

  • When bad men combine, the good must associate; else they will fall one by one, an unpitied sacrifice in a contemptible struggle.
  • So to be patriots as not to forget we are gentlemen.
  • Public life is a situation of power and energy; he trespasses against his duty who sleeps upon his watch, as well as he that goes over to the enemy.
  • The true danger is when liberty is nibbled away, for expedients, and by parts.
  • Liberty, too, must be limited in order to be possessed.
  • If any ask me what a free Government is, I answer, that, for any practical purpose, it is what the people think so, — and that they, and not I, are the natural, lawful, and competent judges of this matter.
  • In effect, to follow, not to force the public inclination; to give a direction, a form, a technical dress, and a specific sanction, to the general sense of the community, is the true end of legislature.
  • All that is necessary for the triumph of evil is that good men do nothing.

Kind Regards....
