Congress Reviews Patent Office

The U.S. patent system will undergo its most substantial overhaul in decades if a bill introduced on Wednesday becomes law. This is a long overdue review of the patent process in the U.S. It looks like the big software companies like the proposed measure, and that it has a very good chance of passing fairly easily. According to News.com:
"Probably the most sweeping change would be the creation of a process to challenge patents after they are granted by the Patent and Trademark Office. 'Opposition requests' can be filed up to nine months after a patent is awarded or six months after a legal notice alleging infringement is sent out."
I know it's not much, but if they keep reviewing the patent process, they might be able to get it into reasonable shape. It's a step in the right direction. Now, if they can just award a patent in less then 5 years ...

More Patent Examiners Needed

The patent office needs to hire more examiners - they are busy recruiting and want to hire 5000 examiners this year. These changes could further increase the number of examiners needed, and prolong the process more.

I think the intent is to make lawsuits less common. The more common they are the more examiners need to go back into the archives to find and compare the 2 patents. If I'm thinking properly about how they operate.
They do need more examiners though.

Fine Print

I'll be interested to read the fine print about the process of challenging patents. This could be quite a field day for patent lawyers. Granted, lawyers need to eat, too; however, our nation's passion for lawsuits does little for our GDP.

Patent Trolls.

Here is another story about patents that came out today on Patent Trolls. The law I was talking about is to stop people from patenting things they never mean to produce and wait for someone to do something similar enough to sue.
