Does a Cellphone Count as a Computer?

Posted February 16, 2011 7:59 AM

From New Scientist - Online News:

Just where is the boundary line between a computer and a cellphone? Does one even exist? The question is particularly pertinent following a recent ruling in January in the US that allowed police to search a suspect's cellphone without a warrant. The thinking behind the decision was to stop suspects destroying potentially incriminating evidence on their phones, in the form of text messages.

My cell phone- the cheapest, most feature-challenged model money can buy, has an internal processor and memory. Same as my computer. My computer can make phone calls (Skype), same as my phone...

I can not carry my computer in my pocket.

I cannot run a finite element analysis on my cell phone.

Oh, yes. My cell phone includes a calculator app. So, it can compute.

What gives the police the right to search either my computer or my cell phone? Is that not like self-incrimination?

Gut, then again, there is nothing on either that would be of much interest to any law-enforcement official, so search away...

If the police ever search my wife's cellphone, they'll lobby for more privacy protections to protect themselves from having to sort through inane drivel.
