Deadbeat partners

11/17/2008 9:20 AM

I'm sure some of you have had the same unpleasant experience of a failed partnership. I am looking for innovative ways (preferably legal) to motivate a deadbeat partner into carrying his share of the load (obligation) of paying off debts left over from a business that failed.

All suggestions will be appreciated. I expect a lawsuit to be involved, but that has certain limits. This deadbeat has transferred all of his personal property to his wife in an attempt to escape his liability. And, I expect to revoke all gifts of the business hardware he has made over the last year to his church, even though he supposedly purchased them from the business. He has yet to contribute funds towards the overall loss equal to myself. All ideas will, of course, be taken with a grain of salt.

1. Dig a hole in a remote location (desert is good) about 3 feet across and 12 feet deep.

2. Place peas (green giant) around the perimeter of the hole.

3. PLace about 12 inches of ashes from your wood fireplaces in the bottom of the hole.

4. Ask you partnner if he would like to have alook at a real estate venture that a new TV evanglical ministry is raving about at your desert location.

5.Take you partner to the excavation site and show him the "location of the lst footing".

6.When he bends over to take pee kick him in the ash hole.

Sometimes all you can do is laugh!

Do you know any guys with names like Guido, or Manny the Enforcer?

Seriously, find out who his lawyer is, if you don't already know. Then ask around to find out which lawyer your ex-partner's lawyer is most afraid of, and hire him or her as your lawyer.

I was also thinking that if his wife found out he was cheating on her, divorced him, and got all the property, that would be just soooooo tragic...

I better stop before I get into trouble.

I've been in a similar situation and know how it hurts, especially if the business was viable had everyone been honest.

Can I suggest that you don't bother going to court, even IF you get a judgement in your favour he'll never pay and the legal costs will negate any gains you make.

Is there currently a legal status of the partnership?

Find out when he gave everything to his wife and his donations to his church.

In Australia, and many other countries, these can often be deemed as given to avoid liability and recovered.

You will need good legal advice, but doing your homework beforehand can significantly reduce the work he will have to do, hence your bill.

Good luck

Many thanks to everyone. Words of humor and wisdom are always appreciated.

As a note to those who may at some time consider a similar foolish adventure, know this:

Never pair yourself with someone of equal or less experience in the business you wish to attempt. Let that be the other guys problem.

Also know that good intentions have no cash value. They are coupons, at best.

Dear guest, if you want to do your home work and too much time has not passed.

Find out about Affidavits, present him with one notarized and requiring a response using only true assertive points he can not deny.

File it into public record and then bill him using the Affidavit as proof of debt.

When he does not pay put liens on all of his assets. A good PI can find his assets.

Of course be ready for the indemnity you will incur for your effort.

This is all prejudicial, he would have to take you to court to get the liens removed (or pay you) A judge can not remove it only a jury if you do it properly.
