UK Libel Reform Campaign

11/22/2010 11:46 AM

Text of an e-mail I received today:

----

Dear Friends,

It has been a busy few weeks for the Libel Reform Campaign.

Internet discussion and libel laws

Yahoo!, Facebook, AOL UK, Mumsnet and the Internet Service Providers' Association (ISPA) have written an open letter to Prime Minister David Cameron, calling for urgent reform of our libel laws to protect online discussion. See the letter to the Prime Minister and coverage in the media here: http://bit.ly/9KBBq5. A new guide to libel laws for bloggers, 'So you've had a threatening letter. What can you do?' and weblink button is now available too, http://bit.ly/bYW5rB, together with a summary of the effects of libel laws on online discussion which we shared with the Ministry of Justice.

Another attempt to silence scientific discussion

Many of you may have read about Dr Dalia Nield, a leading consultant plastic surgeon, who was threatened with libel action for comments about the effectiveness of a £125 'Boob Job' cream. (http://bit.ly/azmfcj)

As we reach the first anniversary of the Libel Reform Campaign – more on that soon – it is vital that we continue to build support to ensure that the Government's proposed draft Defamation Bill will make a real difference to cases like these. Please ask others to add their voices at www.libelreform.org

Best,

Síle and Mike

Maybe, but do we just sit back and let evil win?

These companies provide a platform that it's users have pseudonym for names. On these platforms the users already commit libel on a daily bases. Trashing what ever they feel like with no repercussions. Are they willing to make everyone identify themselves? I think not. So if the platform creates a place that anyone can commit libel at will. Why not hold the platform responsible?

These laws were written to prevent the use of the word from causing harm to someone. Why should they be excluded. What because their a business and didn't author the comment? They printed it, all other sources in the media business have to prove their sources and facts. Why not them, if they don't want to be held accountable then proof what they print.

Can you clarify that, please? Are you saying (for example) that Globalspec should be responsible for everything posted on CR4?

Isn't that why we here have moderators. They do a pretty great job of it. Are they not in doing so taking responsibility for what is printed here. I agree they can't catch everything. To do so would mean to censor it in real time as its printed. Some of those platforms have none are completely open. So people can trash what they choose.

No what I guess I'm saying is do we want businesses that soul attraction is that they can circumvent our laws. Giving those that choose the platform to cause harm to others that they would not find else where. That is what I see is the problem. That is what their exclusion from these laws is asking to do.

I think there are two points here - what the Libel Reform campaign is actually about, and the multiple questions of possibly libellous posting to fora, moderation, anonymous posting etc.

Have you looked at the libelreform.org site? It certainly isn't just for people who want to "trash what they choose" with impunity.

I agree that the moderators do a good job - but as you say, it would be impossible for them to do a perfect job with real-time posts. That's why many sites hold posts in quarantine to be moderated before posting publically. Such a restriction would surely make CR4 a much worse site.

Hey John I have read much the bill proposed. I emit I do not know much about your existing libel laws. But from what I read I have no complaints with the changes. In any real time publication the publisher has no idea what the author will say until he does. The publisher should not be held accountable for it.

But I do believe that the publisher should be able and willing to pull the plug. In the case of a forum someone to moderate and remove potentially harmful or damaging content.

If you were on the sh*tty end of a libel suit, you would not think it such a "completely hogwash issue".

There are many evils - ignoring all but one is not a solution. Neither is trying to hide in the anonymity of "Guest".
