Inventor Urges Patent Law Change

A major British inventor is calling for a change in the law to strengthen protection against those who try to steal ideas. Trevor Baylis, who invented the wind-up radio, has written to the business secretary urging him to criminalise the theft of intellectual property.

In another thread on this forum a few days ago one inventor suggested that inventors simply declare that whatever they have made is a work of art, and that they are artists and that therefore they achieve greater protections.

Fights over patents, and intellectual property rights even as under copyright laws are not new from what I can tell. For this reason alone, I find the subject of interest because of its consistency as a significant and continuous assault on those who create either works of art, or invent.

It is in line with the adage, "The more things change, the more they stay the same.", and there is some lesson about basic human nature to be derived from this that simply because it is not new at all, and so consistent a conflict, that you would think by now that there would have been established a mature body of laws regarding the issue.

Actually it would even appear that there does exist a mature set of laws concerning both patents, and copyrights, but that the corruptions flow from a deep seated longstanding hatred of uncontrolled individual creators.

Ben Franklin is an interesting case for he was a prolific inventor and scientist, participated in creating a nation, and gave away inventions, depending for much of his life on income from printing money.

It would appear that the lesson is you really have to go far out there, to not die in debt, as a creative person, or inventor.

Transcendian I appreciate your thoughtful approach to the problems of patents. From that previous thread you were speaking about "What's a patent worth?" I see the system worked you over at least once. I also got the short end of the stick once in a patent situation but I like you have tried to not let it drag me down. Although granted I have not been worked over as some have been.

My approach to IP law has been a little odd because I have found the whole topic so interesting that I started studying the topic. I also thought the more I know about the topic the better I can handle my future IP work.

Keep up the good work!

P.S. it only seems appropriate to mark my own comment off topic.

It's not the interest of group b to observe any right of group a; only a series of conventions protected by military infrastructure can create any liberalization of it! British law will protect Britons due to the status of sovereign ownership of the markets anything else is just a concession.

At the very end they mention this mediation service. Never heard of it, must be new. Maybe a training camp for P.A's.

The individual single entity inventor has no chance and is open to all kinds of abuse, trickery and misinformation. It is a whole industry out there praying on this species of human.

It is not the stealing but the feeling of being raped that hurts the most, while all are watching and saying: "You should have covered your self more professionally". Like in: "She was wearing a short skirt so we thought she'd asked for it". Having an idea stolen is like loosing a child and being raped at the same time. In today's world, standard procedure.

I applaud the attempt for change but will not hold my breath. The song remains the same. A shame really, Ky.

I fear the effort to tighten the law will only fund the lawyers' new Mercedes. Having had a number of inventions and designs copied, stolen and marketed with a "different type of paint" yes that cost a court case, I have personally given up on patents law. In South Africa we have a challenge in that we, the plaintive has to carry all costs of the case, no legal insurance, and hardly ever a fair trial against the man with the money. Other systems may have some advantage but not here. Better of using a base ball bat to protect your rights!

Having one's invention stolen is one thing. Having one's invention protected by legal papers and lost in a big company safe box is another. One alternative is to make it public. No one can block the rights and the best will manufacture it, likely hiring the inventor for consultance. You'll excuse me if I am off the track but it seams the discussion is in dead lock. [I am an inventor myself.]

After one exercise of going through the experience and expense of applying for a patent, I have given up on the idea of patenting numerous ideas through a lifetime (0ver 49 years-age 69) of inventing, and happier for it. I have been giving away ideas and seeing them get converted to reality by grateful entrepreneurs.

People can only steal ideas but cannot take away your ability to "ideate".

As no idea is perfect to start with, you can enjoy the discomfiture of the copier when he is confronted with the challenge of overcoming problems as the dvelopment progresses and some of them turn back to seek consultancy.
